1. TERMS AND CONDITIONS:
1.1 These Terms and Conditions (the “Terms”) are an agreement between Al Mandoos and you, as a user of the Website. By accessing the Website, registering an Account, ordering any Product, or otherwise availing the services offered by Al Mandoos via the Website, you agree to be bound by the Terms. If you do not agree with any provision in the Terms, your sole recourse is to discontinue your use of the Website.
1.2 The Website is intended to allow you and other users to browse and order products and other goods or services (“Products”) offered for sale on the Website. Al Mandoos will use reasonable efforts to include up-to-date and accurate information in the Website, but it reserves the right to delete, modify, or supplement the content of the Website at any time for any reason without prior notification.

2. ACCOUNT REGISTRATION
2.1 You may browse some parts of the Website without registering, but in order to access certain functions of the Website, including the ability to order and purchase Products, you must register and create an account secured by a password (the “Account”). Any Account so created is personal to you, and you may not transfer it to another person.
2.3 You are responsible for maintaining the confidentiality of your Account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your Account or password.
3. PRODUCTS, ORDERING AND PAYMENT
3.1 As a Registered User, you may use the Website to order and purchase Products. You agree to pay the full amount payable for such Products as indicated during the order process, along with any taxes, shipping costs or other charges applicable to that order. The currency in which prices are displayed may vary, so please pay particular attention to the currency you select. All prices are subject to change without notice.

Al Mandoos will not process your payment (or will cease processing your order) in these types of situations, and will not be liable to you or any third party by reason of its decision to decline processing, or unwinding or suspending any transaction after processing has begun. Al Mandoos reserves the right to refuse service, terminate your Account, or cancel orders, at its sole discretion.
3.4 If the Product is no longer available, Al Mandoos may, at its sole discretion, offer you the opportunity to purchase a Product of equivalent value. This condition will not apply if the Product is temporarily out of stock.
3.5 From time to time, there may be errors in the pricing that appears on the Website or during the order process. There may also be errors in transmission resulting in the interruption of your purchase. Al Mandoos will in good faith try to resolve any issues that may arise as a result of such errors. You agree to cooperate with Al Mandoos to resolve such issues, and you agree that Al Mandoos shall have full discretion to determine the appropriate resolution in such cases, noting that Al Mandoos will verify pricing when processing your order and before we take payment. If Al Mandoos has made a mistake and a Product's correct price is higher than the price on the Website, Al Mandoos may either contact you before dispatch to request whether you want to buy the product at the correct price or cancel your order. If a Product's correct price is lower than the stated price, Al Mandoos will charge the lower amount and dispatch the Product to you after confirmation of payment.
3.6 If the issuer of your credit or debit card refuses to authorise payment, Al Mandoos will cancel your order and contact you for an alternative method of payment. Al Mandoos cannot be held responsible if this should result in a delay in dispatching your Products.
4.1 Shipping costs are as follows:
• Orders of AED 300 or more qualify for FREE delivery an where in the UAE;
• Orders of AED 600 or more qualify for Free delivery (subject to clause 4.3 below) anywhere in the GCC (“GCC” means a country part of the Gulf Cooperation Council); and
• For all other orders, delivery charges will vary depending on the type of Product ordered and the delivery address.
4.2 The cost of delivery will be set out in the order summary shown to you before you pay your order. Please read the order summary carefully and ensure you understand and agree to pay the cost of delivery you order to your address.
4.3 When ordering products from us for delivery outside of the UAE you may be subject to import duties and taxes, which are levied once the package reaches the specified destination. Any additional charges for customs clearance must be borne by you; we have no control over these charges.
4.4 Risk of loss and title for the Products that you purchase on the Website pass to you upon Al Mandoos’s delivery of your ordered and purchased Products to the shipping carrier.
4.5 Al Mandoos may only ship to certain countries (including the UAE). If your country is not one of the countries Al Mandoos ships to, you can contact us to enquire about alternative means of delivery.
4.6 Al Mandoos will provide you with an estimate delivery time upon acceptance of your order. You should use the estimated delivery times as a guide only. Al Mandoos is not responsible for any delays or loss in the shipping of your Product. A delivery must be accepted and signed for by a person over the legal age of majority in your home country. If Al Mandoos is unable to complete delivery because there is nobody at home, it will be your responsibility to contact Al Mandoos to arrange a new delivery time. If Al Mandoos in unable to complete delivery on the first attempt for reasons outside the control of Al Mandoos, Al Mandoos reserves the right to charge you additional fees and any such fees shall be subject to agreement between you and Al Mandoos.
5. REFUNDS AND EXCHANGES
5.1 Al Mandoos wants you to be pleased with your purchase, and so if for any reason you are not completely satisfied, you may exchange, replace, or credit your purchase in accordance with the guidelines set out in this clause 5 (”Refund and Exchange Policy”). You also have statutory rights where Products are defective, which are not affected by the Refund and Exchange Policy.
5.2 Products ordered and purchased through the Website should be returned new, unused, in their original packaging and with all Product tags still attached. Returns that are damaged, soiled or altered may not be accepted by Al Mandoos and may be sent back to you.
5.3 Refunds / exchanges outside the timeframes set out in this Refund and Exchange Policy may not be accepted by Al Mandoos. To initiate the refund / exchange process you can contact us via the ‘contact us form’ on the Website. Al Mandoos will arrange for pick-up within 3 working days from receipt of the request from the same address where the Product was delivered.
• Al Mandoos endeavors to check each item for faults before dispatch. If you receive a damaged Product please contact us as soon as possible. In this scenario, Al Mandoos will try to replace the damaged Product with an item of the same specifications providing this is in-stock. Otherwise, Al Mandoos will refund to you the price of the Product.
• For refunds, Products must be returned within 7 days from the date of delivery.
• Refunds may take up to 15 working days due to varying processing times.
• Al Mandoos will exchange all correctly returned Products for a different size of the original Product. All exchanges are subject to stock availability. If the replacement Product costs more, you agree to pay the difference. If the replacement Product costs less, Al Mandoos will refund you the difference.
• For exchanges, Products must be returned within 14 days from the date of delivery.
• Products cannot be exchanged for color variations as between actual Product and as seen online. Al Mandoos makes every effort to display Products accurately; however, as modes of viewing may vary, Al Mandoos cannot guarantee that the display of any color will be completely accurate.
• Outgoing shipping by Al Mandos for voluntary exchanges (i.e. where you are returning the Product but the Product is not defective) is free:
o on Products ordered and purchased on the Website at a minimum cost of AED 300 and the delivery address is in the UAE; and
o on Products ordered and purchased on the Website at a minimum cost of AED 600 and the delivery address is in the GCC.
You will have to bear the direct cost of returning these Products to us.
6. DISCLAIMER OF WARRANTY; LIMITATION OF LIABILITY; INDEMNITY
6.1 The Website and its content are provided on an "as is" and “as available” basis and, to the extent lawful, with no warranties whatsoever. 5. PRICING AND AVAILABILITY

7.1 We can only deliver to the countries shown in the shipping address of the checkout page. Contact Almandoos for alternative means of purchase for delivery to other countries.
7.2 An estimated delivery date for the product will be advised to you when you receive your order confirmation.
7.3 We will require a signature at the time of delivery of the Product(s). If the purchaser is not present a person over the age of 18 years of age with authority of the purchaser must be available to accept delivery. If we are unable to make the delivery of the Product(s) on the agreed date because there is nobody at home then we will leave a card confirming that we have attempted delivery. It will then be your responsibility to contact us to arrange a new delivery date.
7.4 When it has not been possible to deliver the Product(s) due to no fault of on our part we reserve the right to make a charge for any further attempt to deliver the Product(s). We will agree the amount of the charge any payment with you prior to attempting any further delivery of the Product(s).

All notices given by you to us must be given to us in writing by email or at the address detailed in paragraph 4 above. Notices will be deemed received and properly served immediately when posted on the site 24 hours after an email is sent or three days after the date of posting any letter. In proving the service of any notice it will be sufficient to prove in the case of a letter that such letter was properly addressed stamped and placed in the post and in the case of email that such email was sent to the specified email address of the addressee.

• A Force Majeure Event includes any act event non-happening omission or accident beyond our reasonable control and includes in particular (without limitation) the following:
• Strikes lock-outs or other industrial action
• Civil commotion riot invasion terrorist attack or threat of terrorist attack war (whether war declared or not) or threat or preparation foe war.
• Fire explosion storm flood earthquake subsidence epidemic or other natural disaster
• Impossibility of the use of railways shipping aircraft motor transport or other means of public or private transport
• Impossibility of the use of public or private telecommunication networks
• The acts decrees legislation regulations or restrictions of any government.
12.2 Our performance under any contract is deemed to be suspended for the period that the Force Majeure Event continues and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations under the contract may be performed despite the Force Majeure Event.
13.1 If we fail at any time during the term of a contract to insist upon strict performance of any of your obligations under the contract or any of these terms and conditions or we fail to exercise any of the rights or remedies to which we are entitled under the contract this shall not constitute a waiver of such rights or remedies and shall not relieve you from compliance with such obligations.
13.2 A waiver by us of any default shall not constitute a waiver of any subsequent default.
13.3 No waiver by us of any of these terms and conditions shall be effective unless it is expressly stated to be a waiver and is communicated to you in writing in accordance with paragraph 11 above.
15. If any of these terms and conditions or any provisions of a contract are determined by any competent authority to be invalid unlawful or unenforceable to any extent such term condition or provision will to that extent be severed from the remaining terms conditions or provisions which will continue to be valid to the fullest extent permitted by law.
16. ENTIRE AGREEMENT
16.1 These terms and conditions and any document expressly referred to in them represent the entire agreement between us in relation to the subject matter of any contract and supersede any prior agreement understanding or arrangement between us whether oral or in writing.
16.2 We each acknowledge that in entering into a contract neither of us has relied on any representation undertaking or promise given by the other or be implied from anything said or written in negotiations between us prior to such contract except as expressly stated in these terms and conditions.
16.3 Neither of us shall have any remedy in respect of any untrue statement made by the other whether orally or in writing prior to the date of any contract (unless such untrue statement was made fraudulently) and the other party’s only remedy shall be for breach of contract as provided in these terms and conditions.
17. OUR RIGHTS TO VARY THESE TERMS AND CONDITIONS
17.1 We have the right to revise and amend these terms and conditions from time to time.
17.2 You will be subject to policies and terms and conditions in force at the time that you order Product(s) from us unless any changes to those policies or these terms and conditions is require to be made by law or governmental authority (in which case it will apply to orders previously placed by you) or if we notify you of the change to those policies or these terms and conditions before we send you the order confirmation (in which case we have the right to assume that you have accepted the change to the terms and conditions unless you notify us to the contrary within seven working days of receipt by you of the Product(s)).
18. LAW AND JURISDICTION
Contracts for the purchase of Product(s) through the site will be governed by UAE law. Any dispute arising from or related to such contracts shall be subject to the exclusive jurisdiction of the courts of United Arab Emirates.
